A CHARTER ORDINANCE EXEMPTING THE CITY OF PARK CITY, KANSAS, FROM THE PROVISIONS OF K.S.A. 12-1651 AND AMENDMENTS THERETO, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT, RELATING TO THE DESIGNATION OF OFFICIAL CITY NEWSPAPERS. 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF PARK CITY, KANSAS, AS FOLLOWS:

SECTION 1.          The City of Park City, Kansas (“Park City”), a city of the second class, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt Park City from and hereby makes inapplicable to Park City, the provisions of K.S.A. 12-1651 and amendments thereto, which statute applies to cities of the second class and third class only, and Park City hereby provides substitute and additional provisions thereto as hereinafter set forth.   

SECTION 2.          The Governing Body of Park City shall designate by resolution a newspaper to be the official city newspaper.  The Governing Body of Park City may designate a second newspaper to also be the official city newspaper.  If a second newspaper is designated to be an official city newspaper, then both newspapers shall be the official city newspapers for Park City. 

SECTION 3.          Once designated, the newspaper(s) shall be the official city newspaper(s) until such time as the Governing Body designates a different newspaper. 

SECTION 4.          Newspapers selected for official publications of Park City shall be newspapers that have the following qualifications: 

(1)   It must be published at least weekly fifty (50) times per year and have been so published for at least one (1) year prior to the publication of any official city publication.

(2)   It must be entered at the post office of publication as second class mail matter.

(3)   More than fifty percent (50%) of the circulation must be sold to the subscribers either on a daily, weekly, monthly or yearly basis.

(4)   It shall have general page circulation on a daily, weekly, monthly or yearly basis in Sedgwick County, and shall not be trade, religious or fraternal publication.
