A CHARTER ORDINANCE BY THE CITY OF PARK CITY, KANSAS, AMENDING CHARTER ORDINANCE NO. 14-94 WHICH EXEMPTS THE CITY OF PARK CITY FROM THE PROVISIONS OF AND PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECT PER K.S.A. 12-1692 ET SEQ., RELATING TO THE LEVY OF A TRANSIENT GUEST TAX AND PROVIDING FOR THE PURPOSE AND MANNER OF THE EXPENDITURE OF SUCH FUNDS, BY AMENDING THE SAME SO AS TO INCREASE FROM FIVE PERCENT (5%) TO SIX PERCENT (6%) SAID TRANSIENT GUEST TAX.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF PARK CITY, KANSAS, AS FOLLOWS:

Section 1.  That the City of Park City, Kansas, is a duly incorporated city of the second class within the state of Kansas, and by the powers vested in said city by Article 12, Section 5 of the Constitution of the State of Kansas thereby exempts the city from the operation of and provides for substitute provisions to K.S.A. 12-1692 et seq., which pertains to Transient Guest Tax, by cities located in counties having a population of more than 300,000; said substitute provisions for those Statutes as set forth in Charter Ordinance No. 14-94. That the City of Park City by this Charter Ordinance, amends substitute provisions as set forth in Charter Ordinance No. 14-94 by amending the levy of the Transient Guest Tax from five percent (5%) to six percent (6%).

Section 2.  AUTHORITY

In order to provide revenues to promote tourism and conventions within the City of Park City and within its environs, including the area in and about the Kansas Coliseum, the governing body of the City of Park City, pursuant to Article 12, Section 5 of the Constitution of the State of Kansas, hereby amends its Transient Guest Tax as set forth in Charter Ordinance No. 14-94 from five percent (5%) to six percent (6%).

Section 3.  Charter Ordinance No. 14-94, Section 4, the first sentence thereof, which currently reads:

       A Transient Guest Tax of five percent (5%) is hereby levied within the incorporated area of the City of Park City, Kansas.

shall be and is hereby amended, upon this Charter Ordinance being adopted and approved in the manner required by law, to read as follows:

       A Transient Guest Tax of six percent (6%) is hereby levied within the incorporated area of the City of Park City, Kansas.

That the effective date of said amended levy of tax from five percent (5%) to six percent (6%) shall be February 17, 1998.

Section 4.  EFFECT OF EXISTING CHARTER ORDINANCE

Charter Ordinance No. 14-94 shall continue in full force and effect except as modified hereinabove, namely, the increase of the Transient Guest Tax from five percent (5%) to six percent (6%).

Section 5.  EFFECTIVE DATE

This Charter Ordinance amending Charter Ordinance No. 14-94 shall be published once each week for two consecutive weeks in the official publication of the City of Park City and shall take effect February 17, 1998, at least sixty (60) days after its final publication, unless a petition is filed within sixty (60) days after the last publication date signed by the number of electors of the City equal to not less than ten percent (10%) of the number of electors who voted at the last regular City election with the City Clerk demanding that this Charter Ordinance be submitted to a vote of the electors.
